JCSER condemns the arrest of Jerusalem lawmaker an ex-minister

Israeli police arrested on January 23, the former minister of Jerusalem Affairs Khaled Abu Arafeh and the Palestinian lawmaker Muhammad Toutah from inside the headquarters of the International Committee of Red Cross in Sheikh Jarrah.

Both have been holding a sit-in inside the compound since July 1, 2010 to protest plans of Israeli occupation authorities to deport them from their places of residency in Jerusalem after revoking their residency rights in Jerusalem.

Some 25 members of the police unit, Musta'ribeen (disguised as Arabs) raided the headquarters of the international organization and arrested four Palestinians including the two slated for deportation from Jerusalem. During the raid, Israeli police confiscated their cell phones, computers and other personal belongings.

According to spokeswoman of ICRC Nadia Dibsi, the raid took place at around 1:15 p.m. without any previous notice to the ICRC. She reminded that ICRC enjoys international immunity, a fact that was denied by Israeli police spokesman, Micky Rosenfield who announced that the Red Cross compound does not provide diplomatic immunity.

On September 26, the Musta'ribeen Unit arrested lawmaker Ahmad Atoun and was later deported to Ramallah. Israeli police accused the detainees of affiliation with Hamas. Last year, Israel deported Muhammad Abu Teir to Ramallah after detaining him for several months.

JCSER deplores the arrest and deportation of Palestinians from their places of residency in occupied Jerusalem. It would like to remind the international community that under Art. 4 of the GCIV, Palestinians under Israeli occupation are considered as protected persons.

Moreover, Article 49of the GCIV prohibits Israel, the occupying power, from implementing forcible transfers or deportations of the Palestinian population.

JCSER calls upon the international community to honour their responsibilities in protecting the Palestinian people, ending Israeli occupation and enabling the Palestinians who having under occupation for 45 years, to practice their self-determination.

The centre beliefs that the EU has a basic role in taking measures on the ground to end Israeli occupation enable Palestinians to establish their independent, democratic and viable state. "EU shouldn't suffice with issuing statements and conclusions which are always ignored by the Israeli occupation authority," JCSER concluded its statement.
